Building and construction industry – employee/contractor decision tool

Work agreement

A work agreement typically involves two parties – a payer (the business that pays for the performance of work) and the worker. It can be either written or verbal.

The purpose of the questions on this page is to determine how the worker is engaged. In most cases, a payer will engage an individual to perform the work, but in some cases the payer:

  • will enter into an agreement with a company, partnership or trust for them to provide a worker, or
  • may obtain workers through an intermediary such as a labour hire firm.
directionUsually it is who you pay for the services of the worker that determines how the worker is engaged.

Do you pay a company, partnership or trust (other than a labour hire firm) for the services of the worker?   Yes No
